Provisional Appointment; notice of Board Member to Area 5 Failure to Elect Vacancy

The Solano County Registrar of Voters notified the Benicia Unified School District that no candidate (i.e. failure to elect) had applied to serve Area 5 (map linked) for the November 8, 2022, general election. In response, the Benicia Unified School District Governing Board held interviews to provisionally appoint a candidate to fill the seat at the November 3, 2022, Regular Governing Board meeting.

Four qualified candidates (resident of Benicia living in Area 5, a citizen of California, not employed by Benicia Unified, a registered voter over 18 years of age, and not legally disqualified from holding a civil office) of which the provisional appointee to the board selected was Ariana Martinez on a roll call vote of 3-2.

Notice is hereby given (Ed Code 5092), that unless a petition calling for a special election, containing a sufficient number of signatures, is filed in the office of county superintendent (SCOE- Office of the Superintendent) of school within 30 days of the date of the provisional appointment, it shall become an effective appointment.

Provisional Appointment Timeline:

  • The filing period began on September 16, 2022, and closed on October 14, 2022, at 12:00 pm.
  • The Governing Board interviewed selected applicants and announced the provisional appointee at the November 3, 2022, Regular Governing Board meeting.
  • The Provisional Appointment Notice went out and was posted on November 8, 2022
  • The provisional appointee will be sworn in at the Governing Board Organizational Meeting on December 15, 2022.
